Terms and Conditions

An athlete who purchases coaching or membership, acknowledges the freeze / cancellation policy, all terms and conditions detailed below, AND agrees to make ALL required payments, as outlined in your contract.  Should your credit card become lost or stolen, or your subscription be cancelled or paused at any time for any reason, you agree to inform the Empire Tri Club and update your payment information, and make all payments owed immediately.  Failure to make a payment within 10 days, will result in a $25 late fee PLUS all past-due payments.  Failure to pay may result in immediate termination of your membership / coaching, and you will be turned to a collections agency for all outstanding payments.

Freeze Policy

An athlete who purchases a membership or coaching package is permitted to freeze your subscription at any time for a maximum of 3 months. Members must notify Empire Tri club IN WRITING with 30-days notice, by emailing info@empiretriclub.com or by submitting the digital Freeze Form.  Any charges that occur without 30-days written notice will not be refunded.  Any refunds issued, at the discretion of Empire Tri Club management, will exclude all administrative and Paypal fees.  There is a one time freeze fee of $15, paid in advance.  Fees may be waived and/or extended with extenuating circumstances or medical note.  Athletes who fail to abide by the 3 month maximum freeze allowance may be subject to membership / coaching termination or a rate change.  There is NO FREEZE AVAILABLE for athletes who purchase a seasonal membership.

Cancellation Policy

Cancellation requests must be made via the Freeze / cancellation form found on the Empire Tri Club website, or IN WRITING by emailing info@empiretriclub.com.  Cancellation requests communicated via GroupSpot, text, phone or in person will not be  processed.  Please contact info@empiretriclub.com with questions or requests.

Commitment

An annual tri club membership is a 12-month contract, starting the day you sign up.  Any month which your membership is “paused” or payment is not received, does not count towards your annual commitment.  A free 2-week trial does not count towards your annual membership commitment.

A seasonal membership is roughly 7-months, running from approximately April 1st through the first weekend in November (the NYC Marathon).  Exact dates may vary slightly each calendar year, as outlined in the membership agreement you acknowledge upon joining.

All coaching packages have a 3-month minimum commitment, starting the day you sign up, unless otherwise communicated and agreed to by Empire Tri Club management IN WRITING upon signing up.

Payments

Paid in Full:   Athletes may be given the option to purchase a coaching package or membership for a pre-determined period of time and pay in full.  If an athlete wishes to terminate a contract early, no refund will be issued.  A full or partial credit may be issued at the discretion of the Empire Tri Club, due to reasons such as moving more than 25 miles outside of NYC or injury (with a medical note).

Subscription Plans:. For some products, including coaching packages and annual club membership, a subscription plan may be available, for you to space out your payments in monthly installments.

An athlete who purchases an annual tri club membership agrees to make all payments as part of your 12 month contract.  After fulfilling your annual commitment, an athletes membership will renew month to month and you will continue to be billed monthly until a written request to freeze or cancel is received, either by filling out the FREEZE/CANCELLATION FORM OR by submitting a written notice of cancellation via email to info@empiretriclub.com.

An annual tri club membership will not expire without a WRITTEN cancellation notice.  There is a 30 day cancellation period, and athletes are responsible for paying ALL dues owed within this window. Freeze / cancellation requests are not retroactive, and Empire will not reverse or refund a payment which has already been made.  All refunds issued exclude administrative and Paypal fees.  Cancelling your subscription, failure to pay, or extending a freeze beyond 3 months, do not guarantee your rate when continuing at a future time.  Rejoining the club or resuming a coaching package at a future time do not exclude you from the monthly minimum requirements as defined below:

All coaching packages have a 3-month minimum, after which your coaching contract will continue to renew month to month until a cancelation request is received in writing with 30-days notice.

Athletes are subject to all terms and conditions each time you purchase a membership, regardless of whether you have been a member previously.

After an athlete meets their minimum membership requirement, you may cancel anytime with 30-days notice. Should you wish to cancel your membership, please notify us in writing via email to info@empiretriclub.com or by filling out the freeze/cancellation form on our website.

Early Termination:  If you cancel prior to fulfilling your membership / coaching contract, Empire Tri Club reserves the right to automatically charge your account for the outstanding balance owed PLUS a $100 early cancellation fee.

 

Red Tide Swim Membership:

Free Trial
Upon signing up for a Red Tide Free Trial, an athlete has access to drop in at any ONE swim practice with Red Tide Master’s Swim Team.  Swimmers are NOT required to have a USMS membership to drop in for a free trial, but ARE required to purchase a USMS membership with the purchase of a class card or monthly unlimited membership.

Class Cards
A Red Tide Master’s Swim class card is valid for 3-months from the date of purchase.  Athletes are responsible for brining receipt/proof of purchase to your first Red Tide Workout, upon which an athlete will be issued a Red Tide class card. An athlete is responsible for bringing this card (along with annual USMS membership card) to every Red Tide practice. The 3-month deadline cannot be extended, and this card is not transferable or refundable.  No credits or refunds will be issued if an athlete requests to cancel or does not use all purchased classes.

Monthly Unlimited Membership 
When signing up for a Red Tide Master’s Swim monthly unlimited membership, an athlete will be charged a pro-rated amount for the first month followed by the full amount on the 1st of each month going forward.  To cancel, submit written notice of cancellation to info@empiretriclub.com with 30-days notice.  There is a 30 day cancellation period, and athletes are responsible for paying any outstanding membership dues within this window.  Cancellation is not retroactive, and Empire Tri Club will not reverse or refund a payment which has already been made. This is a monthly add-on only available to athletes with an Empire Tri Club Membership in good standing.   No credits or refunds will be issued if an athlete does not attend any swims, and it is a flat rate for the month regardless of how many swims an athlete attends. Athletes must have a USMS membership in good standing, and are responsible for providing proof of membership if asked by a Red Tide coach at any swim workout.  Swim schedule subject to change at any time without notice.  Some events including open water, stoke clinics or video analysis may be offered for an additional fee.

OTHER:

In addition to the terms and conditions outlined below, all athletes must agree to Empire Tri Club’s privacy policy and participant waiver.
